Електронне голосування: проблеми та перспективи запровадження

Abstract

Стаття присвячена висвітленню однієї з актуальних теоретико-методологічних проблем вітчизняного та зарубіжного права – запровадження електронного голосування. Предметом дослідження є правове забезпечення реалізації такої моделі виборів. Наведено сучасні погляди вчених щодо доцільності запровадження моделі електронного голосування. Аргументована важливість дослідження цієї тематики та проаналізовано досвід зарубіжних країн. У статті зазначені можливі ризики, пов’язані із функціонуванням системи електронного голосування, та запропоновані шляхи їх подолання. Проаналізовано теоретичні основи запровадження електронного голосування в законодавство України. У дослідженні розглядаються необхідність і можливість введення електронного голосування як більш зручного і захищеного виду голосування не лише в Україні, а й взагалі у світі. Автори здійснюють аналіз фактичних переваг електронного голосування, виходячи з його значущості для сучасної демократії. Розглядаються різні моделі запровадження, налаштування й подальшого використання електронного голосування. У статті наведено аналіз основних факторів, що викликають перехід до електронного голосування в сучасному світі, та проблеми, що перешкоджають його запровадженню, насамперед проблема людського та машинного фактору. Надано авторські ідеї щодо вирішення цих проблем. Досліджено основні мотиви запровадження подібної моделі голосування, а саме збільшення виборчої активності молоді. У роботі надано критичну оцінку з приводу ефективності та раціональності основних положень Закону України «Про народовладдя через всеукраїнський референдум» щодо запровадження технології електронного голосування в Україні. Приділяється увага тому факту, що цей закон визначає правові засади здійснення народного волевиявлення через всеукраїнський референдум, його організацію та порядок проведення не тільки в традиційному варіанті, а й з використанням digital-технологій. Автори акцентують увагу на недоліку прийнятого закону, а саме на його поверхневому регулюванні питання проведення електронного голосування. Фактично ми дійшли висновку, що закон лише формально дозволяє проведення такого виду голосування, а не детально регламентує його процесуальні та практичні сторони

The paper is devoted to highlighting one of the topical theoretical and methodological problems of domestic and foreign law – the issue of introducing electronic voting. The subject of the research is the legal support for the implementation of such an election model. The modern views of scholars on the advisability of introducing an electronic voting model have been provided. The importance of studying this topic has been argued and the experience of foreign countries has been investigated. The paper indicates the possible risks associated with functioning of the electronic voting system and suggests ways to overcome them. The theoretical foundations of the introduction of electronic voting into the legislation of Ukraine have been analyzed. The study examines the need for and the possibility of introducing electronic voting as a more convenient and secure form of voting not only in Ukraine, but in the world in general. The authors analyze the actual benefits of electronic voting based on its relevance for modern democracy. Various models proposed by researchers on the introduction, configuration, and further use of electronic voting are considered. The paper provides an analysis of the main factors causing the transition to electronic voting in the modern world and the problems that hinder its implementation, first of all, the problem of the human and machine factor. The author’s ideas as for solving these problems have been provided. The main motives for introducing such a voting model, namely, an increase in the electoral activity of young people, have been investigated. The paper provided a critical assessment of the effectiveness and rationality of the main provisions of the Law of Ukraine "On People's Later through an All-Ukrainian Referendum" on the introduction of electronic voting technology in Ukraine. Attention is given to the fact that this law defines the legal principles of the implementation of the national will of the All-Ukrainian referendum, its organization, and the procedure for conducting not only in a traditional version but also with the use of digital technologies. The authors emphasize the disadvantage of the adopted law, namely on its superficial regulation of the issue of electronic voting. In fact, we came to the conclusion that the law only formally allows for this type of voting, and in detail regulates its procedural and practical aspects
