Abstract Стаття 32 Конституції України передбачає, що не допускається збирання, зберігання, використання та поширення конфіденційної інформації про особу без її згоди, крім випадків, визначених законом, і лише в інтересах національної безпеки, економічного добробуту та прав людини. Конфіденційною є інформація про фізичну особу, а також інформація, доступ до якої фізичною або юридичною особою обмежений (крім суб’єктів владних повноважень). Оскільки процес відповідної зйомки може стати збиранням інформації про особу та суттєво порушувати її певні особисті немайнові права - Цивільний кодекс України передбачає, що фізична особа може бути знята на фото-, кіно-, теле- чи відеоплівку лише за її згодою. Згода особи на знімання її на фото-, кіно-, теле- чи відеоплівку припускається, якщо зйомки проводяться відкрито на вулиці, на зборах, конференціях, мітингах та інших заходах публічного характеру.
Article 32 of the Constitution of Ukraine provides that the collection, storage, using and dissemination of the confidential information about a person without his consent, except in cases specified by law, and only in the interests of national security, economic prosperity and human rights. Confidential is information about an individual, as well as information accessible to the person or entity is limited (except government entities). Since the process corresponding shooting may be collecting personal information and significantly disrupt her some moral rights - Civil Code of Ukraine provides that a person can be charged for photography, film, television or videotape only with its consent. The consent of the person removing him/her for photography, film, television or videotape assumed when shooting conducted openly on the streets, at meetings, conferences, meetings and other events of public character.
